At issue in this appeal is whether substantial evidence existed on the record to support the district courts termination of the parental rights of S.E.P. (mother) to her two young children under Minn. Stat. § 260C.301, subd. 1(b)(5) and (8) (2006). The district court, following a bench trial, terminated father and mothers rights under Minn. Stat. § 260C.301, subd. 1(b)(5) and (8). On appeal, the court of appeals upheld the district courts termination of fathers rights, but reversed as to mother. In re Welfare of Children of S.E.P. and J.W.P., No. A07-25, 2007 WL 2245901, at *4 (Minn. App. Aug. 7, 2007). We granted the countys petition for review concerning mothers parental rights, and we now reverse the court of appeals and reinstate the district courts termination of mothers parental rights.
